The website is operated by LEVINSON DAGAN (hereinafter: “the website management” or “the company”). The website serves as an e-commerce site that offers, among other things, various products for sale (hereinafter: “the products”).

- The provisions of this regulation and the terms of use appearing on the website define the legal relationship between the customer and the website, the terms of use of the website and/or the ordering of products from the website, and indicate the customer’s agreement to these terms and any additional terms appearing on the website.
- The company may update this regulation at any time, at its sole discretion.
- These terms apply to the use of the website and the services included therein through any computer or other communication device (such as mobile phones, tablets, etc.). They also apply to the use of the website, whether through the internet or any other network or communication means.
- Nothing in this regulation shall detract from the provisions of the Consumer Protection Law, 1981 (hereinafter: “Consumer Protection Law”) and the regulations enacted under it, as far as they apply to the website (hereinafter: “the provisions”), except in cases where it is possible to condition the provisions as mentioned, and such conditioning has been made within the website, either explicitly or implicitly.
- The company and the website management make every effort to present the most complete and comprehensive information about the product, including images. Notwithstanding the above, it is clarified that inaccuracies and/or errors and/or omissions may appear on the website in good faith and without malicious intent and/or out of a desire to mislead, and the company, the website management, and the website shall not bear any responsibility arising from inaccuracies and/or errors.
- The chapter headings are provided for the convenience and orientation of the customer and shall not be used in the interpretation of the regulation.
- A typographical error in the description of a product shall not bind the company.
- Product images on the website are displayed for illustrative purposes only. Additionally, there may be differences in appearance, color, size, etc., between the product as presented on the website and the actual product.
- It is prohibited to copy and use, or allow others to use, in any other way, the content from the website, including on other websites, in electronic publications, in print publications, etc., for any other purpose.
- The date recorded, for any matter, in the company’s computers is the determining date for all purposes.

Terms of Use on the Website

Anyone purchasing products and/or intending to purchase and/or receive information through the website and/or anyone browsing the website declares and undertakes that they have read the regulation and agree to its provisions.

Any person over the age of 18 or a registered corporation in Israel is permitted to purchase on the website.

The actions performed on the website shall be solely for the purpose of obtaining information and/or ordering products. The website shall not be used for any other purpose.

The buyer’s order for products will be accepted provided that all the following conditions are met: (1) Approval for the transaction has been received from the buyer’s credit card company and/or payment has been arranged in another way to the satisfaction of the company; (2) The requested products are in stock; (3) The buyer has a personal email account on the internet, unless the transaction is made by phone.

Any person, including a company, may use the website, including making purchases through the website, provided they are capable of performing binding legal actions, possess a valid credit card issued by one of the credit card companies (hereinafter: “the customer”).

Without detracting from the above, the company shall have the right to prevent any person from using the website, temporarily or permanently, at its sole discretion and without prior notice, including in any of the following cases:
- Committing an illegal act and/or violating legal provisions;
- Breaching any of the terms of this regulation;
- Intentionally providing incorrect details;
- Performing an action that may harm the proper functioning of the website and/or any of the suppliers and/or any third party;
- The credit card held by the customer has been blocked or restricted for use in any way.
Purchasing Products on the Website

The purchase of products will be made by adding products to the shopping cart. After adding products to the shopping cart, the customer will enter the following details in the designated online form during the ordering process: first name, last name, phone number, and email address. Additionally, the details of the recipient of the order must be provided: first name, last name, phone number, city, street, house number, floor, apartment, entrance, and any other identifying details that may assist the delivery person in easily locating the property to which the order is to be delivered, including notes and information regarding the delivery process and/or if the recipient is not at home. Fields marked with an asterisk are mandatory and must be filled out; otherwise, the order cannot be completed.

To prevent any possibility of delivery issues, the customer must provide only accurate and correct details.

Upon completing the order, the customer will confirm the order details and the accuracy of the information provided.

Filling in all details is a prerequisite for processing the order to ensure efficient and error-free order completion, and therefore, it is essential to provide all details accurately.

The customer’s details will be updated as stated in the online order form on the website.

Filling in all required details for purchasing the product by the customer will be considered as placing an order (hereinafter: “the order”). Upon receiving the order, the website will check the credit card details, and only after receiving approval from the credit card company and/or after receiving confirmation via an account in an “electronic wallet” service such as Bit or Paybox, the action will be approved, and a final order confirmation will be issued. The customer will be charged for the product through the credit card and/or after receiving confirmation via an account in an “electronic wallet” service such as Bit or Paybox, as explained below, all subject to the availability of the products in the company’s stock and on the website.

The details as entered in the order form by the customer will serve as conclusive evidence of the correctness of the actions.
Customer Service
- Our customer service can be reached via email at levinson.dagan@gmail.com and is intended to assist with order processing, answer questions that may arise regarding various items, their prices, and availability in stock, resolve issues before and after delivery, assist with browsing the website, and receive complaints and compliments.
- Operating hours are Sunday to Thursday from 10:00 to 16:00.
Payment Method for the Order
- Payment for the products will be made via credit card or through an account in an “electronic wallet” service such as Bit or Paybox, or any similar service, as will be available for use on the website from time to time at the discretion of the website management.
- If the customer chooses to use a credit card for payment, they will be asked to provide the credit card details, ID number, card type, and expiration date. If the customer decides to pay using Bit or Paybox, the company will only be able to collect payment for the products after receiving approval from Bit or Paybox. The use and receipt of approval from Bit or Paybox are subject to the terms of use of Bit and Paybox.
- The website management reserves the right to discontinue the use of any payment method on the website, allow the use of additional payment methods, and apply different payment arrangements for different types of credit cards or payment methods that the website management will honor.
- After entering the payment details in the online order form, the customer will receive a confirmation via email regarding the receipt of the order details. It is clarified that this confirmation does not obligate the website management to supply the ordered products and only indicates that the order details have been recorded by the website management.
- Immediately after placing the order, the website management will check the payment method used by the customer, and a suitable notification will be given to the customer that the order has been approved and their account will be charged for the service.
- In the event that the transaction is not approved by the credit card company or any other payment method available at that time, the customer will receive a suitable notification regarding this, and the website management will contact the customer to complete or cancel the transaction.
- The confirmation of the purchase action is conditional upon the availability of the purchased product in stock at the time of the requested delivery and/or at the time of the order. If it is not indicated that the product is out of stock and the product has not been removed from the website by the time the order is placed, the website management will not be obligated to fulfill the order, provided that the website management will refund the customer any amount paid if it was paid to the website management and/or cancel the charge if it was made for the purchase action.
- It is clarified that there may be situations where, despite the item being displayed on the website as available in stock, it is actually out of stock and cannot be supplied. In such cases, the transaction will be canceled, and the customer will have no claims regarding this, subject to the refund of the amount paid by the customer.
- The delivery date will be determined starting from the day the transaction is approved by the credit card company or another available electronic wallet service that has been approved.
- If the customer is mistakenly charged by the credit card company, the customer must notify the website management in order to process a refund accordingly.
Delivery and Transportation of Products
- The delivery of the product by the website will only be made after receiving payment approval from the credit card company and/or another available electronic wallet service, meaning the product has been paid for, as detailed above. The product will be delivered to the address that the customer entered and/or provided during the order process in the online form.
- The website commits to delivering the goods within the delivery time frame to the requested destination and will do its best to ensure that the product arrives promptly.
- The website management will make every effort to deliver the products quickly, within 14 business days from the date of order receipt and approval if sent via registered mail, and within 3 business days if sent via courier.
- Delivery times for products include only the calculation of business days (Sunday to Thursday, excluding Fridays, Saturdays, holiday eves, and holidays).
- Deliveries provided by the shipping company on behalf of the website management are subject to the shipping company’s terms, distribution areas, and prior coordination with the recipient of the order.
- If the shipping company is unable to deliver to the shipping address for any reason, the website management will notify the customer and work to find an alternative solution that meets the desires of both parties.
- In cases where products are delivered via Israel Post, they will be sent to the shipping address provided by the customer at the time of ordering. The products will be sent subject to the delivery time of Israel Post and cannot be monitored or controlled by the website management and/or suppliers.
- The delivery times specified on the website and above do not apply to products that are out of stock on the website and/or from the relevant supplier.
- Deliveries are carried out by a courier company, through which the transportation of the products will be conducted. The terms of the courier company will bind the customer.
- Shipping fees – in addition to the price of the ordered products, the customer will be charged a shipping fee. The amount of the shipping fee will appear at the end of the ordering process according to the shipping method chosen by the customer, unless stated otherwise.
- The shipping fees will be paid along with the payment for the product. In the case of installment sales via credit card and/or another available electronic wallet service, the website may charge the shipping fees with the first payment.
- The website will not be responsible for any delay and/or failure to deliver the products caused by any of the following reasons:
- Force majeure, including but not limited to: war, military operations, emergency operations, natural disasters, and/or events beyond the control of the website, such as strikes and general work stoppages and/or at suppliers of services or goods necessary for the production, supply, or transportation of the product.
- Any reason beyond the control of the website and/or the company.
- Any reason related to the delivery operation.
- Delivery times for the products specified include only the calculation of business days (Sunday to Thursday, excluding Fridays and Saturdays, holiday eves, and holidays).
- The customer must immediately notify the website if the product was not delivered within the delivery period specified on the website. In such a case, the new delivery time will be considered from the day a new date is coordinated.
- It is essential to provide accurate and up-to-date details. If the products are returned to the company due to incorrect details, the customer will bear the cost of shipping and handling fees.
Cancellation of Purchase by the Customer
- The customer may cancel the transaction in accordance with the provisions of the Consumer Protection Law and the regulations enacted under it. Without detracting from the above:
- Cancellation must be made only by written notice to the email address levinson.dagan@gmail.com.
- Cancellation of a transaction by the customer will not be allowed for the purchase of certain items as detailed in Section 14g(d) of the Consumer Protection Law.
- Cancellation of the transaction by the customer is subject to the product being returned, as far as is reasonable or possible, in its original packaging.
- Upon receiving the cancellation notice, the amount paid by the customer for the product will be refunded, minus cancellation fees (shipping fees are not part of the product price and will therefore be deducted separately from the refund) at a rate of 5% of the transaction amount or 100 NIS, whichever is lower. In the case of cancellation due to a defect or non-conformity, the customer will not be charged any cancellation fees. Additional provisions of the Consumer Protection Law regarding the cancellation of the purchase by the customer, including regarding the obligation to return the product, will also apply.
Cancellation of Purchase by the Company
- The company shall have the right, at its sole discretion, for any reason, and at any time, to cancel or terminate a transaction and/or sale and/or to cancel an order, in whole or in part, and/or the operation of the website, in whole or in part.
- A notice of cancellation or suspension of this kind will be given to the user or the orderer, and the company will refrain from charging the orderer’s credit card or will refund any amount paid for the products, if any was paid.
- Except for the refund of the transaction amount as mentioned, the user or the orderer will have no claims, lawsuits, and/or demands against the company and/or the supplier regarding the cancellation of the transaction as stated in this section.
- If it is discovered that a product is out of stock, the website may cancel the order or offer an equivalent alternative item. If such an order is canceled, the website will not be responsible and will not bear any direct, indirect, consequential, or special damages caused to the customer or a third party, including but not limited to damages due to purchasing the item from a third party at a higher price.
Copyrights
- All intellectual property rights, including patents, copyrights, designs, models, and trade secrets, are the sole property of the company or other third parties who have authorized the website management to use them.
- These rights apply, among other things, to the data on the website, including the product list, product descriptions and designs, and any other detail related to its operation.
- These rights also apply to the website name and domain name (https://ld-pottery-48e191.gitlab.io/), and trademarks (whether registered or not) are all the property of the company. No use may be made of them without obtaining prior written consent from the company.
- It is prohibited to copy, reproduce, distribute, sell, market, rent, or translate any information from the website, including trademarks, images, and texts, product designs, product images, etc., without prior written permission from the company.
- It is prohibited to link to content from the website that is not the homepage (deep linking) and to display or publish such content in any way, unless the deep link is to the complete webpage on the website as it is, so that it can be viewed and used in exactly the same manner as it is used and viewed on the website, and this is done with the consent of the website management.
- The website management may instruct the cancellation of a deep link even after granting its consent, at its sole discretion, and in this case, you will have no claims and/or demands and/or lawsuits against the website management.

- The company (and/or anyone on its behalf) is not directly and/or indirectly responsible for any damages arising from and/or related in any way to the repair, assembly, and/or replacement of the products.
- The company (and/or anyone on its behalf) is not directly or indirectly responsible for any damages resulting from the use and/or reliance on information published on external websites, which can be accessed through any of the services on the website. It is clarified that the company does and will do its best to cooperate only with reliable and reputable suppliers.
- The company (and/or anyone on its behalf) is not directly and/or indirectly responsible for any damages arising from and/or related in any way to the use and/or performance of the website.
- In any case, the company will not be responsible for any activity of any other party that is not under its full control.
Confidentiality and Privacy
- All personal details of the customer (name, email, etc.) will be kept in the company’s databases.
- The company will not transfer the customer’s personal details to any other party except to suppliers, as necessary, and only for the purpose of completing a transaction.
- The company will not use the customer’s payment method details except to process payment for a transaction that the customer requested to conduct, and these details will not be transferred to any other party except for this purpose. For the avoidance of doubt, payment method details are not stored in the company’s databases.
- Notwithstanding the above, the company shall be entitled to transfer the customer’s personal details to a third party in cases where the customer has committed an act or omission that harms and/or may harm the company and/or any third parties, the customer has used the company’s services to commit an illegal act, if the company has received a judicial order instructing it to provide the customer’s details to a third party, and in any dispute or legal proceedings.
- The company may use the customer’s personal details, without identifying the specific customer, for the purpose of statistical analysis and its presentation and/or delivery to other parties.
- Since these actions are performed in an online environment, the company cannot guarantee complete immunity from intrusions into its computers or exposure of the information collected by perpetrators of illegal actions. If a third party manages to penetrate the information stored by the company and/or misuse it, the user will have no claims, lawsuits, or demands against the company.
- The company shall be entitled to use “cookies” to provide the user with a fast and efficient service and to save the customer from having to enter their personal details each time they enter the website.
- In cases beyond the company’s control and/or arising from force majeure, the company will not be responsible for any damage of any kind, direct or indirect, that may be caused to the customer and/or anyone on behalf of the customer if this information is lost or if it is used without authorization.
Law and Jurisdiction
- The law applicable to this regulation and/or any action and/or dispute arising from it is solely Israeli law.
- In any case of dispute, the courts (peace or district) of Tel Aviv-Jaffa shall have exclusive jurisdiction to hear it.
- The law applicable to the use of the website, the order, and this regulation, including its interpretation and enforcement, is solely Israeli law.
